[If you appoint a data protection officer, add: Data protection officer: [NAME], [E-MAIL]. A DPO is mandatory under § 38 BDSG only if 20 or more people are permanently engaged in automated processing of personal data, or where processing requires a data protection impact assessment. Delete this paragraph if it does not apply.]
2. Scope
This policy explains how we handle personal data when you visit https://agilis-jettech.com, use our performance configurator, request a datasheet, or contact us. Personal data means any information relating to an identified or identifiable natural person under Art. 4(1) GDPR.
3. Your rights
You have the right to:
- Access the personal data we hold about you (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16)
- Erasure, where no legal retention obligation applies (Art. 17)
- Restriction of processing (Art. 18)
- Data portability in a machine-readable format (Art. 20)
- Object to processing based on legitimate interests, including profiling (Art. 21)
- Withdraw consent at any time, with effect for the future (Art. 7(3))
- Complain to a supervisory authority (Art. 77)
To exercise any of these, write to info@agilis-jettech.com. We respond within one month.
Right to object under Art. 21 GDPR. Where we process your data on the basis of legitimate interests, you may object at any time on grounds relating to your particular situation. If you object to direct marketing, we will stop immediately and without needing a reason.
Supervisory authority. You may complain to the authority for the state in which we are established: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2-4, 40213 Düsseldorf. You may also complain to the authority where you live or work.
4. What we process, why, and for how long
4.1 Visiting the website
When you load a page, our hosting provider automatically records: IP address, date and time, page requested, referring URL, browser and operating system, and the amount of data transferred.
- Purpose: delivering the site, security, and detecting misuse
- Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest is operating a secure and functioning website.
- Retention: 7 days. Where a specific security incident is under investigation, up to 30 days.
4.2 Contact and quotation requests
If you use a contact form, the datasheet request form or write to us by e-mail, we process the details you provide, typically name, company, e-mail address, telephone number and the content of your message.
- Purpose: answering your enquiry, preparing and following up a quotation, and administering any resulting business relationship. This includes contacting you by e-mail or telephone about that enquiry.
- Legal basis: Art. 6(1)(b) GDPR where the contact relates to a contract or pre-contractual steps at your request; otherwise Art. 6(1)(f), our legitimate interest in responding to business enquiries.
- Retention: enquiries and quotations are commercial correspondence and are retained for six years from the end of the calendar year in which they arose (§ 257(4) HGB, § 147(3) AO). Where a message forms an accounting document, eight years applies. Correspondence with no commercial content is deleted after twelve months.
4.3 Performance configurator
The configurator processes two kinds of information.
Technical parameters you enter about your vessel and engine: length, displacement, hull form, engine power and speed, together with the calculated result.
Contact details: name, company, work e-mail address and telephone number, which you provide in order to see the result.
- Purpose: calculating an indicative performance estimate, sending you that result, and contacting you about your enquiry.
- Legal basis: Art. 6(1)(b) GDPR (pre-contractual steps at your request) and Art. 6(1)(f) (our legitimate interest in following up business enquiries).
- Retention: contact details and the linked submission are retained for six years from the end of the calendar year, as commercial correspondence.
- Anonymised technical data: after that period we delete the contact details and retain the technical parameters and results in anonymised form, indefinitely, for product development, statistical analysis and improving our calculation models. Once anonymised this information can no longer be linked to you and is no longer personal data within the meaning of Art. 4(1) GDPR.
The calculation is performed on our server. It does not involve automated decision-making producing legal or similarly significant effects within the meaning of Art. 22 GDPR.
4.4 Product and technical updates
If you tick the optional box to receive product and technical updates, we use your e-mail address and name to send them.
- Purpose: sending information about our products, technical developments and company news
- Legal basis: Art. 6(1)(a) GDPR, your consent
- Retention: until you withdraw consent. Every message contains an unsubscribe link, and you may also withdraw by writing to info@agilis-jettech.com. Withdrawal does not affect the lawfulness of processing before it.
- Proof of consent: we retain a record of when consent was given, and the wording shown, for the duration of the consent and for three years afterwards, on the basis of Art. 6(1)(f): our legitimate interest in demonstrating compliance and defending claims within the limitation period under § 195 BGB.
4.5 Analytics
We use Plausible to understand how the site is used. It is configured to work without cookies and without storing or accessing information on your device, and it does not create cross-site profiles or track individual users. IP addresses are processed only transiently and are not stored.
- Purpose: measuring reach and improving the site
- Legal basis: Art. 6(1)(f) GDPR, our legitimate interest in understanding site usage. Because no information is stored on or read from your device, § 25 TDDDG does not apply and no consent is required.
- Retention: aggregated statistics only, no personal data retained.
[IF YOU LATER ADD COOKIE-BASED ANALYTICS OR ADVERTISING, replace with a section describing each tool, its provider, purpose, cookie lifetimes, third-country transfers and the consent mechanism, and state the legal basis as Art. 6(1)(a) GDPR together with § 25(1) TDDDG.]
4.6 Applications and other correspondence
Where you send us job applications or other correspondence, we process the data you provide for that purpose only. Application data is deleted six months after the process concludes unless you consent to longer storage. Legal basis: § 26 BDSG, Art. 6(1)(b) GDPR.
5. Recipients
We do not sell personal data, and we do not pass it to third parties for their own marketing purposes.
Within our company, only those staff who need your data in order to answer your enquiry, prepare a quotation or administer the business relationship have access to it.
We use external service providers who process personal data on our behalf and strictly on our instructions. Each is engaged under a data processing agreement pursuant to Art. 28 GDPR. They fall into the following categories:
- Providers of website hosting and content delivery
- Providers of form handling and e-mail communication
- Providers of website usage statistics
- Providers of systems used to manage enquiries and customer relationships
Personal data may additionally be disclosed to our tax advisers, auditors and legal advisers where necessary for those services, and to public authorities and courts where we are legally obliged to do so.
If you would like to know which specific service providers we currently use, write to info@agilis-jettech.com and we will tell you.
Transfers outside the EU/EEA. Some of our service providers process data outside the European Union or European Economic Area. Where they do, the transfer is safeguarded by the European Commission's Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR and, for providers in the United States, by their certification under the EU-US Data Privacy Framework where applicable. You may request a copy of the relevant safeguards from info@agilis-jettech.com.
6. Is providing data mandatory?
Providing personal data is not required by law or contract. However, we cannot answer an enquiry, send a datasheet or return a configurator result without the contact details requested on the relevant form. Marketing consent is entirely optional and refusing it has no effect on anything else.
7. Security
We use TLS encryption for all data transmitted through this site, and appropriate technical and organisational measures under Art. 32 GDPR to protect data against loss, misuse and unauthorised access.
8. Changes
We may update this policy where our processing or the legal position changes. The current version always applies, and the date at the top shows when it was last revised.
